Contract Vetting

More and more contracts are either bespoke contracts or standard forms heavily amended. Contract vetting means reveiwing the contract documents and highlighting the risks and liabilities that are encompassed within those documents.

Melbury has in-depth knowledge of all the major standard forms of contract (including the JCT, NEC, ICE etc.) and can therefore understand the full effects of any proposed amendments to those standard forms.

Contract vetting is a service that is regularly used by our clients, because they are aware that it is important to understand what risks and liabilities they face before they commit themselves to a contract.

Account Management

Melbury provides a quantity surveying service from when the order is placed through to the agreement of the final account. As part of this process it is ensured that valuations are measured and submitted in detail and on time, appropriate letters are issued when required and the final account is promptly agreed.

Training

Melbury provides training and seminars on many subjects including:

• Standard Forms Of Contract and Subcontract (e.g. NEC 3, JCT 2005, etc)
• Contract Awareness
• Commercial Awareness
• Dispute Resolution - Adjudication etc

The seminars can be either:

• Breakfast, half-day or full-day in-house seminars (and workshops)
• Free Public Breakfast Seminars
• Other training to suit a particular requirement

Dispute Management

Adjudication

Melbury regularly represents parties in Adjudication actions.

Mediation

Melbury provides advice to parties that are considering using Mediation, and can represent parties at a Mediation Meeting.

Arbitration

Melbury provides a service of representing parties from the initial stages of an Arbitration (i.e. the issuing of the Notice), through the preliminary meeting, all of the procedural processes, the Hearing, and up until the Final Award is issued.

Litigation

Melbury is not a solicitors' practice and therefore cannot represent parties in court. However, nearly all construction disputes must be dealt with through a Pre-Action Protocol for Construction and Engineering Disputes, and Melbury can deal with all aspects of that Protocol process.
